SOPA & PIPA Strike and Protest

On Wednesday, January 18, 2012, the Internet (well, a majority of websites, including Wikipedia, WordPress, and many thousands) are blacking out in protest of the SOPA and PIPA legislation currently before Congress.

On Jan 24th, Congress will vote to pass internet censorship in the Senate, even though the vast majority of Americans are opposed. We need to kill the bill - PIPA in the Senate and SOPA in the House - to protect our rights to free speech, privacy, and prosperity. We need internet companies to follow Reddit's lead and stand up for the web, as we internet users are doing every day.

Stop Online Piracy Act (SOPA) and the PROTECT IP Act (PIPA), two pieces of legislation that the Internet industry says will halt innovation and undermine free expression. With so many big Internet sites participating tomorrow, be prepared and support the protest. Mozilla, the maker of the popular Internet browser Firefox, is another of the big names joing the day of protest and Google, although not blacking out, will be posting opposition to these two pieces of legislation on their sites.

It is the opinion of the English Wikipedia community that both of these bills, if passed, would be devastating to the free and open web. The decision to shut down the English Wikipedia wasn’t made by me; it was made by editors, through a consensus decision-making process. But I support it.

Google said Tuesday that it will post a statement on its Web site voicing its opposition to the Stop Online Piracy Act, joining a drive that will see Reddit, Wikipedia, and Boing Boing take their Web sites dark for a period of time on Jan. 18. Google’s actions will not be as dramatic as others — Reddit and Boing Boing will take their sites down for 12 hours starting at 8 a.m., while Wikipedia will black out its English content for 24 hours on Wednesday — but the company’s decision to use its U.S. home page means that its arguments regarding SOPA will reach a huge audience.

In a statement, Google’s news team said, “Like many businesses, entrepreneurs and web users, we oppose these bills because there are smart, targeted ways to shut down foreign rogue websites without asking American companies to censor the Internet. So tomorrow we will be joining many other tech companies to highlight this issue on our US home page.”

Establishing Recall Elections

in the State of Texas

Texas is one of many states that do not allow Recall Elections, except in "Home Rule" or "Charter Cities" and then only limited by the constraints of the city's Charter. With the increase of career politicians who do not effectively represent their constituents and the overwhelming dissatisfaction with the performances of our elected officials, it is time that Texas had a State Recall mandate and law. It is to that end that this article is being written. You are hereby encouraged to work together with me to begin the process that will hold elected officials accountable to the people, not corporations or big donors. Please respond with comments and suggestions that will assist in achieving our intention and I'll gather everything together and send the comments to Donna Howard, State Representative, District 48, Austin, Texas.

Late last year, in 2011, I sent a letter to my State Representative, Donna Howard, District 48, in Austin, Texas, inquiring about how to proceed to alter the Texas Constitution to allow for ReCall Elections of State Elected officials.

Here is the response I received from the Honorable Donna Howard, State Representative, District 48, Austin, Texas:

Dear Mr. St.Troy;
Thank you for contacting me with your question about how to change Texas law to allow for recall elections for state and federal officials. You are among the nearly 162,000 people I represent, and I apologize for my delayed response.

You may be aware that the Texas Legislature meets for 140 days at the beginning of each odd-numbered year. Outside that period, we may only convene at the request of the Governor to consider issues that he places on the agenda. So, the Legislature will not meet again until January 2013 unless Governor Perry calls a special session. That means you have plenty of time to plan and think about the type of legislation you would like to see since legislators may not begin filing bills until after the next general election in November 2012.

I usually begin to research my legislative agenda during this interim period between sessions, but I do not finalize my legislative package until after I know whether or not I have won re-election. In the mean-time, I have attached a list of questions that I would consider when deciding what to include in a bill authorizing recall elections. You can also contact my Chief of Staff, Elanor D'Ambrosio, with any other specific questions about the legislative process.

I would also encourage you to contact your Congressman, the Honorable Michael McCaul, with your inquiry, I do not believe that an individual state may pass a law allowing for the recall of a federal official, and his office will be better equipped to explain the steps necessary to enact this type of policy at the federal level. I have included Congressman McCaul's contact information below.

This is the attachment she included with her letter asking questions about creating a recall election for the State of Texas (My comments are included in Red and have been emailed to the Honorable Donna Howard) :

1. Can the recall election be initiated only on specific grounds - for example, conviction of certain felony offenses - or should the law include some sort of statement indicating that grounds for a recall can be political rather than judicial in nature? A Recall election can be initiated on grounds of suspicion of illegal acts, constituent disapproval, or any grounds that are reasonable and customary in accordance with state laws.

2. Which elected officials will the recall provision apply to? The recall provision should apply to ANY elected OR appointed official within City, County or State government, including judiciary representatives.

3. Who should be elgible to sign the recall petition? Should this right be limited only to those who live in the district of the official being recalled? (This would not apply to statewide officials.) Any Registered Voter within the selected City or County OR any Registered Voter in the State of Texas for State officials.

4. How many signatures should be required on a petition for a recall? Should the number have some relationship to the number of people who actually voted in the last election for the office being recalled, should it relate to the number of people who are registered and elgible to vote for that office, etc.? A minimum of 20% of Registered Voters should be required to initiate a recall election.

5. How long should the petitioner have to gather signatures and when can a petition be submitted? (This could vary since the house members run every two years and state senators run every four years.) A petitioner should be granted 3 months to obtain the required number of signatures to be submitted. The recall petition should be allowed to be presented at any time regardless of election year or the time of session.

6. Who will pay for the recall election? The counties in which the recall election is being held or the state? For City recalls, that city shall be responsible. For County recalls, that County shall be responsible. For State recalls, then the State of Texas shall be responsible. For any recall that affects a City, County and/or State together, then the costs should be allocated proportionately.

7. How will the recall election be conducted? Should the recall election be held simultaneously with the election for a successor? Should the election for a successor be separate? Should the successor be appointed instead of elected? After the recall has been initiated and the appropriate signatures obtain and the petition submitted to the governing authority, then the successor should be voted for at the same time of the recall election in order to save costs for further elections. A successor should never be appointed.

Love; The true Gift of Christmas!

Christmas isn't a holiday I've actively celebrated for many years now. Perhaps it is because of the over commercialization of the holiday or the pain from years of watching others not truly understand what this holiday is about. As a child I was taught that this was Jesus' birthday, then I grew up and learned this day was actually an old Pagan celebration called Saturnalia that the early church decided to take over to convert the Pagans to Christianity.

No one knows the actual date of the mythical Jesus (yes, I said mythical, as there is no record to acknowledge his physical presence upon this earth), so the real reason for the season isn't to celebrate Jesus' birthday. It's to celebrate a Pagan celebration, another attempt by the Christians to control everyone and everything without any regard to the value of age old traditions, cultures, or even humanity.

Yes, I grew up in the Christian church, learned the teachings of the Bible, and even became a Southern Baptist Preacher. I used to love Christmas and the decorating and gift giving, but now there is no reason for the season for me as I have watched with dismay for many years the very negative affect that Christians have upon the world. Let me say that in all of my 49 years, I have only met a few people that I would actually say were Christ Like (which is what is meant by the term Christian). Those people have all had a profound affect upon my life and will always be remembered for their actions through love, even when they may not understand or approve, but their love guided them, not hate.

Thank you Martha Meda Taylor, thank you Ellen Rose Synder, and thank you to those whose names I can no longer remember, but your actions I still do. You all showed me what it meant to be a Christian in a world where so many do not live the life of Christ, yet call themselves follows of Him.

If only all of those that call themselves Christians would live their lives as He did, then our world would indeed be a better place, yet sadly, they do not and instead choose to act as the Sagacies and Pharicees in the stories of Jesus that he condemned. Jesus showed and taught love, acceptance, and more importantly he taught living a life of love through your actions, not through your words. Oh, if only these modern day Christians would know what it is they are doing to the name of Christ through all the hate they spread, through building monuments to themselves when they should be giving to the poor and needy.

Jesus condemned the Pharisees by saying,

"you also outwardly appear righteous to men, but inside you are full of hypocrisy and lawlessness"

This year I chose to honor my beloved grandmother, Vera B. Lee, this Christmas and instead of a tree there is a beautiful Christmas Cactus and some red Poinsettias. She lived her life through love and encouraged me through her acts of love to do the same. This year, for the first year in ages, I sent out cards and I received some thoughtful gifts - two of them. I've been invited to join the celebrations at other friend's homes, but today is a day I shall spend with myself, accompanied with my two lovely canine companions.

One of the very thoughtful and directly meaningful gifts was presented by another friend, a lady who lives what she believes. Thank you Shannon! Here is the gift she gave, a framed poem about Christmas:

As the new year of 2012 approaches, it is being welcomed by a new resurgence of Civil Disobedience and Civil Unrest as people around the globe have grown tired of tyranny, corrupt governments, restrictive laws, and of being challenged for equal rights. The Mayans, many cultures and doomsday prophecies have indicated that the year 2012 will mark the end of things as we know it. Perhaps they were right, but not in the "end of the world" viewpoint (which it might be), but rather through the unrest of the people who will stand up and cause governments to topple, liberties to be regained, and to demand equal rights no matter who they are or what their religious beliefs may be.

This year marks a milestone in that Time Magazine's Person of the Year, isn't an actual person. Instead it is the Protester, the people that have fought for freedom, stood up against corruption, and have changed the 'status quo'.

Once upon a time, when major news events were chronicled strictly by professionals and

printed on paper or transmitted through the air by the few for the masses, protesters were prime makers of history. Back then, when citizen multitudes took to the streets without weapons to declare themselves opposed, it was the very definition of news — vivid, important, often consequential.

In the 1960s in America they marched for civil rights and against the Vietnam War; in the '70s,

they rose up in Iran and Portugal; in the '80s, they spoke out against nuclear weapons in the U.S. and Europe, against Israeli occupation of the West Bank and Gaza,

against communist tyranny in Tiananmen Square and Eastern Europe.

Protest was the natural continuation of politics by other means.

The two decades beginning in 1991 witnessed the greatest rise in living standards

that the world has ever known. Credit was easy, complacency and apathy were rife, and street protests looked like pointless emotional sideshows —

obsolete, quaint, the equivalent of cavalry to mid-20th-century war.

We can no longer sit idly by as corruption grows, civil liberties are taken away, and basic human rights are denied. If you are enjoying life, it may be within a gilded cage. Our responsibility is to defend justice and make our voices heard in order to affect positive change and create a peaceful world.

'Massive and effective street protest' was a global oxymoron until —

suddenly, shockingly — starting exactly a year ago, it became the defining trope of our times.

And the protester once again became a maker of history.

Many may not support the current protests happening around the globe, however, they are expressing the very concerns that many of us share - Civil Liberties, Human Rights, The End of Corruption, and The Demand for Accountability. Thus, here's some information about why Occupy Wall Street is growing in momentum and quotes to encourage action, not silence. It's not just the 99% that are speaking out, but also those with respect for justice, such as U.S. Secretary of State Hillary Rodham Clinton in her speech to the United Nations.

Occupy Wall Street is a people-powered movement that began on September 17, 2011

in Liberty Square in Manhattan’s Financial District, and has spread to over 100 cities in the

United States and actions in over 1,500 cities globally. #ows is fighting back against the corrosive power of major banks and multinational corporations over the democratic process,

and the role of Wall Street in creating an economic collapse that has caused

the greatest recession in generations.

The movement is inspired by popular uprisings in Egypt and Tunisia,

Justice Department Settles with Kentucky Apartment Complex Involving Allegations of Disabiilty-based Housing Discrimination

WASHINGTON — The Justice Department announced a settlement of its lawsuit against the owners, developers, architect and civil engineers of Park Place Apartments, a 276-unit complex in Louisville, KY, resolving allegations that those involved in the design and construction of the complex discriminated against people with disabilities. Under the settlement, which must still be approved by a federal district judge in Louisville, the defendants will pay all costs related to making the apartment complex accessible to persons with disabilities and pay $275,000 to compensate 29 individuals who have been harmed by the inaccessible housing.

"The Fair Housing Act requires equal access to housing for persons with disabilities,” said Thomas E. Perez, Assistant Attorney General for the Civil Rights Division, “and this comprehensive resolution will ensure equal access at this apartment complex and compensate those injured by the defendants’ failure to provide accessible housing.”

“Our office is committed to ensuring that all Kentucky residents have equal access to housing,” stated David J. Hale, U.S. Attorney for the Western District of Kentucky. “We will continue to build on our record of enforcing fair housing laws and remove these barriers that are discriminatory to Kentuckians with disabilities.”

The defendants responsible for the payments and retrofits are Kevin Cogan, Doris Cogan, Edwynn Burkle, George Clark, the Estate of James A. Hall, Bayus Inc., Mindel Scott & Associates Inc. and A. Stanley Willett. The retrofitting includes modifying walkways, removing steps, providing accessible curb ramps and providing accessible walks to site amenities, such as the clubhouse, pool, mailbox and trash facilities. It also requires the defendants to reconfigure thermostats and outlets to accessible heights, increase door widths and reconfigure bathrooms and kitchens.

The lawsuit arose from a complaint that was filed with the Department of Housing and Urban Development (HUD) by a former resident of Park Place Apartments, who is represented by the Lexington Fair Housing Council, a Kentucky-based non-profit organization that enforces federal, state and local fair housing laws. HUD referred the matter to the Justice Department, which conducted its own investigation and subsequently filed the lawsuit in August 2010.

The federal Fair Housing Act prohibits discrimination in housing based on race, color, religion, national origin, sex, disability and familial status. Getting to Zero: World AIDS Day 2011

Red is one of the common colors seen in December, however, on December 1st every year, the color red takes on a new meaning. Red is the color of the AIDS Ribbon, which will be prominently displayed on Thursday, December 1st, as today is World AIDS Day. The theme for World AIDS Day 2011 is "Getting to Zero." After 30 years of the global fight against HIV/AIDS, this year the focus is on achieving 3 targets: Zero new HIV infections. Zero discrimination. Zero AIDS-related deaths.

On the first of December, World AIDS Day is celebrated. This day is an opportunity for people to unite in the fight against HIV/AIDS, to remember those who have died of the disease and to celebrate accomplishments, such as increased access to treatment and prevention services. This day is an opportunity to take action and to show your support for the 33.3* million people worldwide living with HIV/AIDS.

Today, despite advances in HIV treatment and in laws designed to protect those living with HIV; many people do not know the facts about how to protect themselves and others from HIV or about the stigma and discrimination that remain a reality for many people living with HIV. World AIDS Day is an important reminder to individuals and governments that HIV has not gone away – there is still a vital need to raise money, increase awareness, fight prejudice and improve education.

People around the globe will participate in various events to celebrate life, to begin conversations, to show support, and to honor those that have died. Such as Facing AIDS - "you and your community can help reduce stigma and promote HIV testing by putting a face to AIDS."

2011's Theme is Getting to Zero

"World AIDS Day was first conceived in August 1987 by James W. Bunn and Thomas Netter, two public information officers for the Global Programme on AIDS at the World Health Organization in Geneva, Switzerland. Bunn and Netter took their idea to Dr. Jonathan Mann, Director of the Global Programme on AIDS (now known as UNAIDS). Dr. Mann liked the concept, approved it, and agreed with the recommendation that the first observance of World AIDS Day should be 1 December, 1988. In its first two years, the theme of World AIDS Day focused on children and young people. These themes were strongly criticized at the time for ignoring the fact that people of all ages may become infected with HIV and suffer from AIDS. But the themes drew attention to the HIV/AIDS epidemic, helped alleviate some of the stigma surrounding the disease, and helped boost recognition of the problem as a family disease." Some Facts about HIV/AIDS

Nearly 1.2 million people are living with HIV in the U.S. (an estimated 1,178,350 adults and adolescents), and one in
five of those (20 percent) are unaware of their infections. Despite increases in the total number of people living with HIV in the U.S. in recent years, the annual number of new infections has remained relatively stable overall.
However, HIV infections continue at far too high a level, with approximately 50,000 Americans becoming newly infected with HIV each year.
More than 16,000 people with AIDS still die each year in the U.S.
MSM (Men Who Have Sex With Men) represent just 2 percent of the U.S. population, but account for 61 percent of all new HIV infections in the U.S. each year, as well as nearly half of people living with HIV (49 percent).
Individuals infected through heterosexual contact account for 27 percent of annual new HIV infections and 28 percent of people living with HIV.
While blacks represent approximately 14 percent of the U.S. population, the latest CDC estimates show that they account for almost half of people living with HIV in the U.S. (46 percent), as well as nearly half of new infections each year (44 percent).
Hispanics represent approximately 16 percent of the population and the latest CDC estimates show that they account for more than 17 percent of people living with HIV in the U.S., as well as 20 percent of new infections each year.

Why "Getting to Zero?"

This years theme for World AIDS Day is Getting to Zero, as mentioned about, and puts the focus on the need to prevent the spread of the HIV virus, to prevent discrimination of those with HIV/AIDS, and to reach zero deaths by HIV/AIDS.

It is estimated that 33.3 million people have HIV worldwide, with 1.2 million persons who are living with HIV in the United States, according to the Center of Disease Control (CDC) estimates. This number is expected to continue to increase over time, as advances in treatments prolong the lives of those who are infected and more people become infected with HIV each year. Despite increases in the total number of people in the U.S. living with HIV infection in recent years, the annual number of new HIV infections has remained relatively stable. However, new infections continue at far too high of a level, with approximately 50,000 Americans becoming infected with HIV each year. Worldwide, the rate of new infections, or incidence, has decreased. In 33 countries, the incidence has decreased more than 25 percent since 2001, including countries in the hardest hit areas of sub-Saharan Africa.

The CDC estimates that one in five people living with HIV in the U.S. are unaware of their infection. This highlights the importance of reaching all infected individuals with HIV testing and prevention services. HIV can be transmitted in three main ways: sexual transmission; transmission through blood; and mother-to-child transmission. These three routes of transmission work in tandem to affect segments of the population. The number of infections resulting from each route will vary greatly between countries and population groups. HIV counseling and testing are fundamental for HIV prevention, as is access to essential commodities such as condoms or sterile injecting equipment.

According to UN Secretary-General Ban Ki Moon, "Stigma remains the single most important barrier to public action. It is a main reason why too many people are afraid to see a doctor to determine whether they have the disease, or to seek treatment if so. It helps make AIDS the silent killer, because people fear the social disgrace of speaking about it, or taking easily available precautions. Stigma is a chief reason why the AIDS epidemic continues to devastate societies around the world."

Discrimination against those infected with HIV/AIDS includes both the fear of getting the disease and also negative assumptions about people who are infected. AIDS-related stigma has had a profound effect on the epidemic’s course. The World Health Organization cites fear of stigma and discrimination as the main reason why people are reluctant to be tested, to disclose their HIV status or to take antiretroviral drugs.

"We can fight stigma. Enlightened laws and policies are key. But it begins with openness, the courage to speak out. Schools should teach respect and understanding. Religious leaders should preach tolerance. The media should condemn prejudice and use its influence to advance social change, from securing legal protections to ensuring access to health care." Ban Ki-moon, Secretary-General of the United Nations.

More than 25 million people between 1981 and 2007 have died from the virus worldwide, making it one of the most destructive pandemics in history. In the US, nearly 594,500 people with AIDS in the US have died since the epidemic began.

The goal of ‘Zero AIDS Related Deaths’ signifies an increased access to available treatments for all those infected. Currently, only one third of the 15 million people living with HIV worldwide who are in need of life long treatment are receiving it. Universal access to antiretroviral treatments for those living with HIV will not only decrease the number of AIDS related deaths, but will increase the quality of life among those infected and decrease transmission.

World AIDS Day is an opportunity for all of us to learn the facts about HIV. By increasing the understanding of how HIV is transmitted, how it can be prevented, and the reality of living with HIV today-we can use this knowledge to take care of our own health and the health of others.

That's why I'm not voting for any Republican for elected office. I won't be voting for any career politician, for any of those that falsely invaded other countries, or any person that favors corporate personhood or religious sanctioning in government affairs.

Life as an Adventure, Discover Yourself

In life, as in business, there are times when we need to get away from the stress, find new points of view to help us grow, and to discover new experiences that challenge us. Recently I was reminded of just how much my travels have helped me through life, so I wanted to share some of the many places I've traveled to and a bit about how these travels and experiences have guided my life.

Lets start with one of the most amazing adventures.

Just outside of Leon, Nicaragua, is a fairly new volcano. This active volcano smolders with the smell of sulphur everywhere. The steep slopes are covered in a fine volcanic ash, which makes it challenging to climb, but great fun for getting back down. Here's the video of me Volcano Boarding on Cerro Negro Volcan.

The excitement and physical challenge allowed for a renewed belief that I could accomplish amazing things in life, even if I fail. All it takes is to get back up, pull yourself together and keep going, laughing at the misfortune and walking forward with friends.

I've hiked volcanoes, I've hiked through Central American jungles to discover some amazing waterfalls, I've hiked across Canada and met some incredible people, and I've slept in Hostels where the lessons from fellow travelers were appreciated. In all, my travels have allowed greater insight into the lives and cultures of others, have created new ways of seeing my own life, and have led to some great friendships.

2 day Hike in Celaque National Park (at the peak you can see the surrounding countries and it is a Cloud Forest as you walk through the clouds to get to the top) in Gracias, Honduras. Being alone with a friend with no other living person in the area really allowed for an awakening view of life, as if something happened to either of us, we were in real trouble.

And finally, through new friendships, knowledge, experience and desire grow. We are ever changed when we experience new cultures, try new things, and become friends with people from around the world. What we bring back is a new expression for those around us, and for me, a renewed sense of self and the strong desire to live!

When a friend or client discloses their battle with cancer, it is often an unsettling moment for them and for you. My friend and client Melissa showed great courage over the last few years while dealing with cancer, so this year when she asked if I would support her by donating, I agreed. A Poem Can Change Your Life Path.

Today, after a rather exhausting day of working with a dear friend on her landscaping, I arrived home and checked email. One thing led to another and a moment later I was reminded of a poem that changed my views some many years ago. The poem was given to me on a plaque by an old boyfriend. I'm grateful for the gift he gave, as it has indeed "made all the difference." Now I want to share that poem. It's by Robert Frost and is shared from the Poetry Foundation.

By taking the road "less traveled by" my path took me to many places, introduced me to many people, taught me many lessons, and encouraged growth, insight, and knowledge. I am who I am today because of the path I chose and even though I acknowledge that I am a bit to handle, I love who I have become, as I am one of a kind. Thank you Robert Frost for the poem.

Oh yes, today I received an email from Vice President Joe Biden, well, I'll admit, I'm on the email list. It's about time he and President Obama started putting pressure on the Republicans to actually accomplish something important (other than raking in billions in campaign contributions and passing absurd laws that only restrict our freedoms, continue tax breaks for big business, and causing the demise of the our country.).

If you aren't on the email list, I'm sure the White House won't mind me re-posting it here for your reading pleasure.

I want to make sure you heard a piece of news from Capitol Hill today.

This morning, Holly Petraeus, who has been leading an office at the Consumer Financial Protection Bureau to protect military families, went to Capitol Hill to highlight some of the most abusive practices our service members face in today's financial marketplace.

She explained that military families are the targets of predatory lenders. She talked about how many service members and their families struggle to make ends meet -- especially during deployments. And she said that the CFPB will help combat the lenders who try to take advantage of people with deceptive, unfair, and abusive lending practices.

But here's the thing: The Senate still hasn't confirmed President Obama's nominee to lead the CFPB, a former Attorney General from Ohio named Rich Cordray. The bureau needs a director to fully ensure that the debt collectors, private student loan providers, and payday loan providers are properly supervised and that consumers are not put at risk of falling prey to the same kinds of abusive practices that helped cause the worst financial crisis since the Great Depression.

Rich has spent his career advocating for middle class families, and enjoys broad, bipartisan support from the elected officials, business leaders, and consumer groups who have worked with him.

Take a minute to read what Holly had to say, and share her testimony with those you know.

Holly Petraeus is the daughter of a decorated general, wife of a four-star general, and mother of an Army soldier who served in Afghanistan. I don't know if there's anyone who better understands what it means to be part of an American military family.

She just gets the stress and challenges that those who serve in uniform, as well as their loved ones, face.

And that's exactly why she joined the CFPB, to safeguard our military personnel and their families.

Republicans in Congress could be taking steps to grow the economy by passing the American Jobs Act. There is no reason why John Boehner should send his members home to their districts without passing a single measure President Obama has proposed to help put the country back on track. Nor is there any reason why the Senate should require 60 votes on these proposals. Republicans could be helping to ensure that every American family gets a tax cut. And Republicans should be working to protect consumers by confirming Rich Cordray.

We can't wait. That's why I want you to hear from Holly Petraeus. I want everyone to understand how much sense it makes for the Senate to put Rich Cordray to work.

Ken Herman's article in the Austin American Statesman on Occupy Austin

Today I read an article in the Austin American Statesman by Ken Herman that showed a total disregard for what some hard working people are trying to do through the Occupy Austin movement, which is part of the Occupy Wall Street movement. I was disappointed that the Statesman website didn't allow commentary on the article, which shows that they have no interest in the opinions about this topic and only desired to represent their (or should I say, his) views. Thus, Ken Herman and the Austin American Statesman, here is my comment about the article:

Although I agree with what seems to be the key question, "does camping out at City Hall accomplish anything?" I have to admit I support the Occupy Movement for it's intended purpose of drawing attention to the lack of control and oversight of the banking and Wall Street systems, along with the fact that such banks and Wall Street are not being held accountable for causing the current financial crisis. They believe that something should be done to correct the social inequalities that our government and judicial system have created.

There are many increasingly frustrated people in our country who probably feel that they have no voice within our government (a very true statement of fact and a sad commentary of our representatives lack of being in touch with the people they represent). Thus with such frustrations, people are doing something, which is always good, as long as it is peaceful and nonviolent. The real issue of this article should have been about what is causing the movement to increase and gain momentum, it should cover the reasons Occupy Austin is demonstrating and camping out. If the frustrations are not allowed an outlet and the people have no voice in our government, then the next step could be civil unrest leading to violent actions.

When our freedoms are being taken away daily, when we no longer have a voice in our government, and when our government allows banks and other financial institutions to run a muck without regard to how their actions (and may I note, lack of taxes and fees on financial transactions) affect everyone in our country, then yes, "sleeping and waving signs" does accomplish something. It gives an outlet to the building frustration and helps people be heard!

We the people are responsible for what has happened, because we have not involved ourselves in our own government and now are paying the price heavily. We have to become active in our government by Voting, by being an INFORMED Voter, and encouraging others to do the same. This next year we will show our voices loudly when the career politicians are removed from office (click here to see how your representative is doing) and our new representatives favor the people, not big business, banks, and major interests. Voting should not be suppressed by the radical Tea Party and the extremist Republicans, voting is our Right!

Austin Pets Alive and the ASPCA $100,000 Challenge.

We're down to the last three days of the ASPCA Challenge and thanks to your help, we're a main contender for the $100,000 prize for the most adoptions AND the $25,000 prize for community engagement.

$125,000 would save a lot more animals in Central Texas! We will use the money to continue pulling more and more animals from euthanasia lists from Central Texas animal shelters to spread no-kill from Austin to all of Central Texas.

All Dried Up? Ways to Survive the Texas Drought

We've all heard that Texas is in the grips of a severe drought and that people and wildlife are having a hard time as a result.

While we can't control the weather, there are things that we can do everyday in our homes and businesses to help conserve water and ensure there is enough for people and the environment during these dry times.

We have assembled some of our favorite tips below. Every drop of water saved is important and with no end in sight for this drought, it is necessary. It all comes down to using only what you need!

Top 10 Tips to Conserve Water:

Only run the dishwasher or washing machine with a full load. If it is time to replace either of these appliances, check in with your utility about rebates for water-conserving versions and purchase those instead.
Water your lawn on the right day. Are you odd or even? Most Texas cities restrict outdoor water use to one or two days a week during times of drought. Save water and avoid fines by learning and following your city's schedule.
Catch the condensation from your AC unit and use it in your yard. Depending on how your air conditioner is programmed, it can produce gallons of water per day. Catch that water in a bucket and put it on your garden, shrubs, and trees.
Turn the water off when you brush your teeth. This simple step can save up to eight gallons of water per day.
Fix leaky faucets. Leaky faucets can waste up to 7 gallons of water per day. To check for leaks at home, read your water meter and avoid using water for 2 hours. Read the meter again after this period. If the amount is different you have a leak.
Fix running toilets. Running toilets can waste a lot of water. Fix these leaks as soon as you find them. Check with the manufacturer of your toilet for the proper replacement "flapper" to ensure maximum efficiency.
Inspect your irrigation system. Have your system inspected by your water utility or a certified irrigator to make sure it is operating correctly, identify any problems, and help you set it to run more efficiently. Many cities offer free inspections.
Install faucet aerators and low-flow shower heads. These water saving devices are cheap and easy to install. Many utilities give them away to their customers. Check with your utility and pick up a few extras to share with your neighbors!
Install a high efficiency toilet. Toilets account for about 25% of water used in the home. Depending on the age of your toilet, you can save up to 5 gallons per flush by replacing older models. Check with your city for possible rebates.
Make water conservation a whole-family activity. Challenge your family members to think of new ways to save water and to be part of the solution.

When it comes to Architecture, many rely upon traditional construction and design methods, but mother earth is eagerly awaiting a more environmentally friendly way of living, so when I discovered this amazing home, I had to share it.

From a time long ago, but more and more people are constructing such homes around the world these days. Perhaps they have something positive to suggest to the rest of society - Protect mother Earth and build respectfully. Here's the lead-in from the article:

The house was built with maximum regard for the environment and by reciprocation gives us a unique opportunity to live close to nature. Being your own (have a go) architect is a lot of fun and allows you to create and enjoy something which is part of yourself and the land rather than, at worst, a mass produced box designed for maximum profit and convenience of the construction industry. Building from natural materials does away with producers profits and the cocktail of carcinogenic poisons that fill most modern buildings.

Some key points of the design and construction:

Dug into hillside for low visual impact and shelter
Stone and mud from diggings used for retaining walls, foundations etc.
Frame of oak thinnings (spare wood) from surrounding woodland
Reciprocal roof rafters are structurally and aesthaetically fantastic and very easy to do
Straw bales in floor, walls and roof for super-insulation and easy building
Plastic sheet and mud/turf roof for low impact and ease
Lime plaster on walls is breathable and low energy to manufacture (compared to cement)
Reclaimed (scrap) wood for floors and fittings
Anything you could possibly want is in a rubbish pile somewhere (windows, burner, plumbing, wiring...)
Woodburner for heating - renewable and locally plentiful
Flue goes through big stone/plaster lump to retain and slowly release heat
Fridge is cooled by air coming underground through foundations
Skylight in roof lets in natural feeling light
Solar panels for lighting, music and computing

Life with Adonis, Canine Mental Illness

Over the past few weeks I've watched my friend go from being un-trusting to faithful, but there is a question in my mind. If humans can have mental illness, can dogs? The discovery of him not having ear drums, which explained him not responding to voice helped and now I'm working with him through doggie sign language. He and I both have to learn it.

One on one with me Adonis does great, but when other pets are introduced he becomes aggressive again, like today when I brought home the two new Beagle/Terrier puppies. He acted the same way almost two weeks ago when he and I came to house and dog sit for some friends. Adonis became friends with Shadow within a few days and have played well ever since. I've had my companion on Pet-Eze, a natural combination of herbs to help keep him calm. It seemed to be working until today.

Now as I sit here, I watch my poor dog growl at something unseen as he stares into nothing. He still occasionally growls and snips at me, but I've learned to growl right back and jump in his face to let him know he's on my turf. He calms down for a bit, except tonight. Is it the introduction of the 2 new puppies? Is it something more serious?

I decided to foster the puppies after I saw how much Adonis enjoyed having another canine playmate, but now I'm not so sure it was a good idea. I'll give him a few more days and hopefully he'll adjust like he did with Shadow.

But the thought still remains. Is it possible that he has a mental illness, brain damage, or something else that causes his unfriendly behavior? My heart weakens as I watch him stare into nothing and growl, my mind wonders what he sees.

I knew that he would require a special home, so I adopted him after fostering him for 2 weeks. Patience and understanding I have with animals, there are times I wish I had such with humans.
Next week he and I will visit the vet to follow up with his ear infection, but I'm also going to be talking to the vet about heart worm treatments, and maybe finding him doggie Valium. My friends all say that a dog is like their owner, so it's no wonder he's here with me - both almost deaf, both with mental disorders, and both with social stigmas. I'm working on mine, through my therapist, my doctor and my psychologist. Now to find a way to help my little companion.

Knowing that this next month is going to generate a great deal of medical bills for Adonis, I'm asking the universe to bring me some work to cover the extra costs, just like it did this month. My only desire is to see him happy, healthy, and able to socialize well with others, human and animal. For now, I enjoy the quiet as he has fallen asleep, but he's on my bed, so I'm sleeping on the floor.

I'll research as much as I can, learn, and find ways of helping him, as in between the episodes I see a loving, sweet, affectionate dog. Adonis, you're safe with me and together we'll find a way.

Fanta and Squirt

Early this afternoon I met some adorable pups named after various brands of soda. These two are Fanta and Squirt, a brother and sister. They are a Beagle and Terrier mix and about 8 weeks old. As with all pups, they love to run and play. Originally, when I first met these two, Squirt (the boy and biggest of the two) was the first one to come to me, so naturally I thought Fanta was a bit shy. Fanta isn't shy. They both are enjoying chasing me in the grass, something I found they enjoy doing, but now I'll have to run and run fast, as Fanta can keep up to my slow pace.

As part of the Austin Pets Alive fostering program, I'll have these two playful companions for a bit. House breaking, leash training, and hopefully getting my newly adopted dog, Adonis, to play nice will all be part of the routine.

I'll admit, I haven't house trained a dog in quite sometime, so this will keep me on my toes for sure. The joy in playing with these two is tremendous. Today is the first day I've had them, so there isn't much to write about yet, but wanted to share the photos and a video of them playing.

No matter how dire the situation, Senate Republicans seem determined to prove they can act irresponsibly.

Senate Republicans are unanimously supporting a draconian constitutional amendment that they claim will balance the budget, but is really nothing but a cowardly ploy to force devastating cuts to vital social programs, including Social Security and Medicare, while writing into the constitution an impossible requirement — a two-thirds vote — to raise taxes.

Last week, in a column called "Getting to Crazy," Paul Krugman closed by noting that "there has been no pressure on the G.O.P. to show any kind of responsibility, or even rationality — and sure enough, it has gone off the deep end."

We agree. We need you to be part of that pressure. Even though we know it is unlikely that Republicans will break ranks and do the right thing, we must hold individual Republicans like Sens. Hutchison and Cornyn accountable to reality and let them know their constituents see through their fantasy proposals.

Even worse, the amendment the Senate Republicans are backing wouldn't actually balance the budget, rather it would arbitrarily cap government spending at 18% of Gross Domestic Product (GDP).

To put this in perspective, the last time government spending was 18% of GDP was 1966. And no president in nearly half a century, Republican or Democrat, has even proposed a budget where spending is 18% of GDP or less.¹

It's simply insane.

And this is the crux of the real problem.

The Big Lie spread by Fox News and its Tea Party allies is that the United States — the richest country in the history of the world — is too broke to afford a social safety net.

The fact of the matter is that right now we are confronting the effects of a tax-cutting binge and an eagerness for wars of choice that conservatives and so-called moderates in both parties have been indulging in for decades.

You have to go back 60 years to find a time where the U.S. government took in less taxes revenue relative to our GDP than the government takes in today.²

And yet, the Republicans tell us that they think the responsible thing to do is to put Social Security and Medicare on the chopping block so we can afford tax cuts for the Koch brothers.

They need a reality check that only you can provide.

Education Or Indoctrination?: Texas School Board Dives Into ‘Spiritual Battle’ Over Science

The Texas State Board of Education is heading back into the news this week.
The 15-member elected board will convene for a public hearing  on Thursday to hear testimony and on Friday to debate and vote on instructional materials for public school science classes. Since Texas legislators don’t have enough funding to purchase new science textbooks, the state will buy $60 million  worth of online supplemental science materials based on the board’s recommendation.
This is not something scientists, educators, parents and civil liberties groups are taking lightly. The board is infamous for its adoption of science curriculum standards in 2009 that left open the door for approval of creationist materials.
What’s more, on July 1, Texas Gov. Rick Perry appointed Barbara Cargill (R-Woodlands) to serve as the chair of the board. Cargill, a former science teacher,believes  that the debate over science education is a “spiritual battle.”
Cargill has voted with the board’s far-right bloc since elected. She is a strong proponent  of teaching the “strengths and weaknesses” of evolution – code language for religiously grounded attacks on accepted science — and was instrumental in the board’s passage of the current science standards.
During the 2009 debate, Cargill nominated  Ralph Seelke, a crony of the Discovery Institute, to serve on the recommendations panel. The Discovery Institute is a Seattle-based outfit that pushes so-called “intelligent design,” a variant of creationism.
This round of Texas deliberations doesn’t seem to be any different. Cargill is responsible for appointing  one of three anti-evolutionists serving on the current science review panel. The panel will make recommendations to the state board about the science materials.
In a recent speech to the Eagle Forum, Cargill explained  her concern that the board was short one Christian since it approved the creationist-friendly curriculum standards in 2009.
“Right now there are six true conservative Christians on the board, so we have to fight for two votes,” she said. “In previous years, we had to fight for one vote to get a majority.”
Her comments alerted critics that Cargill planned to continue voting based on her fundamentalist religious beliefs – not based on what scientists recommend or what’s best for Texas students.
Her words also offended  other members of the board. Though they choose to vote for sound science, they are also Christian and don’t like intimations that they aren’t.
“It’s going to continue the divisiveness rather than bring us together for the benefit of the schools and the kids,” said  board member Thomas Ratliff (R-Mount Pleasant), a Sunday school teacher and leader in the United Methodist church. “She’s continuing to draw a line that is very judgmental.”
But for all the criticism Cargill has received from fellow board members and scientists, she’s drawn praise  from the Religious Right.
Needless to say, there is reason for alarm once again in Texas.
If you live in the Lone Star State, let the board of education know that you want sound science materials produced by scientists – not the Religious Right.

Federal Reserve seeks comments regarding proposed rule

The Federal Reserve, which received sweeping new authority under the Obama regulatory reauthorization, wants to effectively eliminate seller-held (a.k.a. purchase money) mortgages. It will do this by enacting a rule for the Dodd-Frank Act prohibiting property sellers from taking back a mortgage unless the buyer essentially can qualify for conventional financing! What’s more, Ma and Pa Homeowner, who create 95% of seller-held mortgages, won’t be able to qualify buyers under the same underwriting standards that banks are required to perform, and therefore the cash flow notes won’t be created.

If this is enacted it also will remove access to housing for millions of Americans, because seller “financing” is the only way people who can’t qualify for conventional loans can buy a house. Moreover, it would allow a buyer a three year right of rescission (they can cancel the sale) if the seller did not properly qualify them. The right of rescission also applies to anyone who buys the note. We have precious little time to try to stop this.

Seller “financing” provides housing for millions who otherwise could not qualify for conventional loans.
Homeowners are not bank officers or mortgage lenders. By requiring them (many if not most of whom who take back a mortgage are elderly) to qualify buyers using bank standards means they will simply refuse to sell with owner financing. Thus millions of people will be deprived of home ownership.
Why should the buyer be required to divulge their income and assets to the very person with whom they are negotiating the terms of a sale? This is not required when there is a 3rd party lender.
Requiring the buyer to turn over all their financial information to a stranger opens the door for identification theft and fraud.
This also creates the opportunity for predatory borrowing. This is where an unscrupulous buyer knowledgeable about the Dodd-Frank Act leads an uninformed seller (and this will be the majority of sellers) into negotiations not in compliance with the ability-to-repay requirements. (An example of that could be a balloon, an interest rate greater than 1.49% above a standard mortgage, or the seller did not know how to calculate the income-to-debt ratio correctly, or know what residual income means). That buyer lives in the property trying to resell it for a profit and if they are not successful within three years they rescind the sale and get all their money back.
By not allowing them to negotiate a balloon payment, there is a good chance that a seller 55 years or older will die before receiving all their equity. A lot of seniors have invested in real property with the intent of selling it using seller financing (an installment sale) in order to supplement their income in retirement, but also with the hope that they would not be stuck with a 30 year investment. The Dodd-Frank Act does the same thing insurance companies do who sell 30 year annuities to seniors. Our government has criticized this deplorable practice because seniors will die before they receive all their investment.
The restriction of no balloon doesn’t affect just seniors, it has financial consequences for anyone using seller financing. Under the Dodd-Frank Act community banks are allowed to originate fully amortizing loans with a five year balloon. The rationale is that they hold these loans in their own portfolios and the government recognizes their need to hedge against inflation and rising interest rates. Yet, the Act does not recognize that private property owners who have 100% skin in the game need the same protection. A five year balloon is predatory lending. If there has to be a restriction it should at the very least be the same allowance given to community banks of a balloon in 5 years.
There are a lot of small builders that have a spec house or two that they can’t sell unless they offer great terms using seller financing. Otherwise they have to let these properties go back to the bank, which does not help housing or the economy.
It has been said that a seller financing the sale of his or her own property would completely avoid the issue of licensing by retaining the services of a licensed loan originator. If a mortgage loan originator (MLO) fails to properly follow the ability-to-repay guidelines the buyer still has three years in which to rescind the sale which leaves the seller at risk and will most likely bankrupt them.

Meet ALL of our adoptable kittens with this mild skin condition. Ringworm is just like athlete’s foot – easily treatable, but it sometimes takes awhile. We don”t want these cute cats to wait any longer for homes. We want them to go home now, and finish up treatment with their forever families!

Treatment typically takes 3-4 weeks and is super easy: oral meds once a day and special baths twice a week. We will send you home with the medications and supplies you’ll need to treat your new family members.

Ringworm FAQs

What is Ringworm? It is a fungus that lives everywhere, including on animals, people, and in the soil. You probably have come in contact with it in your day to day life multiple times and not ever known it. It is very hardy and lives a long time in the environment, and is contagious.

Am I going to get ringworm from my new kitty? Maybe, but its doubtful. Typically healthy people don’t catch ringworm, and if you are good about washing your hands and changing clothes after handling ringworm kitties then you should be fine.

What if I get ringworm!? I promise you it is no big deal if you do manage to catch it. It’s a red crusty little spot. If you’ve ever had athlete’s foot or jock itch, then you’ve already had a skin fungus like ringworm :) It is super easy to treat on humans because we aren’t furry, just a little miconazole spray (over the counter) works perfectly for it.

We have lots of ringworm fosters, volunteers, and adopters that deal with ringworm kitties every day and they usually don’t catch it. If they do, a bandaid, some anti-fungal spray or cream a few times a day, keep the area clean and dry, and it clears up pretty quickly. http://ringworminhumans.com

What about my other animals? Unless your animal is immunocompromised (young, old or sick) it is VERY unlikely they will catch it. Again, washing your hands and changing clothes in between handling the RW kittens and your personal animals will definitely help.

What treatment do they need? Once daily oral medicine and twice weekly bathing with a stinky medicated dip. Pretty easy. You will be provided with the oral medicine, the medicated dip, gloves, a scrub top to wear when handling/dipping kittens, instructions for treating the kitties – everything you need to treat them for free!

What about it getting in my house? if you put them in a bathroom or other confined tile space clean up is super easy. Ringworm is killed by dilute bleach, so when they leave just spray down the tile where they were and litterbox and stuff, wash their laundry in bleach, vacuum your carpets, and you should be good to go! You’ll also be given more detailed decontamination instructions to make sure your house is ringworm free when you’re done with treatment.

Adonis, who wasn't feeling very good just over a week ago, nor very trusting of people, is now getting belly rubs, taking walks, and is starting to be friendly to people. He's a great companion, especially if you're able to build trust with him. He's not your usual dog, but he is sweet, loving, and a great protector. He even likes to play with his favorite blanket by pulling it around the apartment.

There are many dogs and cats available for adoption through Austin Pets Alive, and Adonis will one day want a home.

Having often times been called slow, different, or any other number of names, all because I was different than other people. It seems I know a bit more about Adonis, my foster pet through Austin Pets Alive, as each day passes, I begin to see signs of just how different he is and ponder if those differences were what caused him to be abandoned and hurt.

I'll watch him put his nose in the corner and stand there, as if he has been scolded. I laugh when he pulls his blanket (an old towel) through the apartment only to sit down and just hold it in his mouth for hours. He only once has laid back and exposed his belly for a scratch and that was after some rough housing we were doing and when he started to snip again, I growled back, so he submitted. He loves to be petted now, but only while he is standing up. Behind the ears are his favorite spot, but I can see that the belly rub is going to soon take over. Now that there isn't much pain in his back, he lets me scratch his back.

Although he is allowing me to pick him up, I do so carefully, because there is something that still causes him fear or pain, but he doesn't bite as before, only does a little high pitched whine and snip.

His diarrhea is gone, along with the horrible flatualance smell, since I've changed his food over to an organic type. His new doggie treats are vitamins for hip and joints, so I can see that they are helping him. He'll spend an hour going over one of the small meaty bone treats. Being close is something he is doing more and more. He moves his blanket to either beside my bed or under the bed, and every now and then I'll awake with him sleeping beside me.

I think I would like to take him to a doggie psychic and a vet, to see if we can pinpoint some of the issues he has and what he has gone through before now.

Tonight, after several walks, he started to crouch to relieve himself, I had to yell, "NO!", jumped up, grabed the leash, opened the door, and held the leash for him to run through on the way out the door. We made it. He's been so good about going to the door and scratching on it to let me know he wants to go outside.

Perhaps him coming to stay with me was for good reason, as I think we understand each other and we both have to learn to trust again. He's a great dog and hasn't been barking at people during our walks and is showing more curiousity about the things, animals and people around.

The movie "Forest Gump" comes to mind every time I play with him, something we do every night on the floor. He's special, so hopefully there will be someone equally special who knows how to love and appreciate this handsome little man. It's only been a week now, but we've come a long way together, so I'm excited to see how much further we can go.

Austin Pets Alive needs other foster parents, and every time I see a request, I want to say, 'Yes', but then I don't because I'm not sure how Adonis will react just yet. So soon, I'll say 'Yes' to another foster so Adonis will learn to be around other animals.

If you're special, like Adonis and me, then you might be great with some of the foster pets (you'd only have them for a short period, care for them, give them medications, and train them, and then help them find adoptive homes.) I'm glad my friend Shannon insisted that I do this, as the rewards are numerous. I'm loving again, I'm not alone, and I have love coming back in funny ways.

Companionship, Pets, and HIV & AIDS

Pain can cause many of us to not respond well to those around us, to not be very socially minded, and to snip at others around us. Such is the case with Adonis, the loving Chihuahua I'm fostering at the moment. Since his arrival on Saturday, he has become more relaxed. The one-on-one environment seems to be good for him, as he is becoming more trusting, loving, and affectionate.

During our walks, you can tell that he so wants to run about and be the 2 year old that he is, but his hurt back limits that fun. His curiosity is amazing and no sound or smell escapes his attention. Laughter breaks out when I see him get excited and start to run. He skips with his hind legs and runs with his front ones. I know it is because of his back issue, but I hope one day he'll be free of the pain and able to run like he wants to. He enjoys his walks and isn't barking at everyone now, like he did when he first arrived.

Our first night together didn't provide much sleep because he barked at every sound or movement in the window (my apartment has a floor to ceiling window so he can see everything). Last night was different, we both slept. Probably because he was more relaxed in his new home. I awoke to find he had moved the towel he's been sleeping on over to beside my bed to be closer to me. Slowly looking over at him, he smiled and began wagging his little curled tail. It is such a joy to be greeted with such warmth and excitement.

As he begins to trust me, I've discovered that he loves to have his ears scratched. He is so funny and acts like a cat by doing little head butts into my side for me to pet him. Both of our affections for the other are growing. He's a great companion and his small size makes him perfect for the small apartment. Having him around helps me as well. His loving, affectionate, and charismatic nature (it really shows when he's not in pain) provides the love this apartment, and I, have needed.

There are many of us living with HIV and AIDS and the ones I know that have a pet seem to have a bit of purpose and are enlivened by the company and love of their pets. Over the last few days I've pondered the idea of how to help Austin Pets Alive, the organization I'm fostering for, and those living with HIV and AIDS by developing some sort of companionship program to allow no or extremely low fee adoptions and placements of the dogs and cats at APA to those with HIV and AIDS. It could be a great way to provide some love to people who really need it and a home to many of the pets temporarily residing at APA. Thee may be such a program, but I couldn't find one while searching the Internet, but I did find programs to assist those with HIV/AIDS keep their pets, such as PAWS.

I may live on a limited income, but thankfully I am able to work from home, but I'll spend my last bit of money to make sure Adonis has food, fun, and a comfortable place to live. It was lonesome here before he arrived, and now, I smile every day and have someone to converse with, to walk with, and to curl up with. A big smile emerges as I see his protector side exposed, as he will do a little bark towards anyone walking by the window (I keep the blinds pulled up so he can see outside). He may be small in stature, but he is big in heart. Adonis is a great pet.

UPDATE: 10/29/2011
I ended up adopting the little dog I've been fostering from Austin Pets Alive, as he is a very special guy. Like me he doesn't hear very well because he doesn't have ear drums, he's had a rough life and apparently no one treated him very well. The good news is that now that he has been with me for the last many months, he is becoming more playful, loves to curl up in my lap, really enjoys his daily runs, and is becoming more sociable. Oh, because the name Adonis is so powerful and carries with it so much of a reputation, I've changed his name. He is now Freckles. A name is your spirit, your energy, and he now has fun.

Meeting a handsome man, one that was just as attracted to me as I am to him, has long been a desire. On a sweltering Austin summer day a few emails were exchanged, a few phone calls shared, and before the sun shone its last bit of shine, the charismatic, handsome, energetic Adonis walked into my life. A companion brightens your days, creates laughter, and it means you have someone to curl up with. He may not be the man for everyone, but he is the man for me, as we're walking together, enjoying meals together, and playing on the floor together. At the moment, with a great deal of trust on his behalf, he allowed me to help him up onto the sofa to curl up with me and enjoy a movie. He's a bit timid of others, probably from his earlier years, but there is a love that sparkles in his eyes when I catch him staring at me.

With a name like Adonis, just like the Greek God he's named after, he is youthful, beautiful, and probably destined to share 3 loves in his life. The initial introduction required a bit of patience as the door opened and he slowly took a lay of the land and stepped out and onto the carpet. This is his home now, just as much as it is mine, so on this day of chilling out together, each in our little spaces, we've slowly begun the sweet lovers dance. Laughter rages as he pushes and pulls away his head from inside my arm as we lay here on the sofa. Yes, getting him up here took a trust point from him to trust me to pick him up, you see, he has a hurt back which needs healing, and that's why he is here - To get better so he can share his loving, energetic, playful, and ever so bright personality with a family that can one day provide him a permanent home.

As I type, he's curled up here next to me on the sofa, lazily glancing up at me, almost like he's trying to get a full history report on my life. But the key is, that he's on the sofa, he jumped up and I lifted him the rest of the way. I do so enjoy a sleeping companion, one like Adonis who's charms could cause any to melt under his warm, steamy, in-depth stares.

I have to admit something here, Adonis is not of the human clan, he is from the canine clan, a chi in fact. He weights less than 10 pounds, is covered with a bright white, short haired coat with a small brownish spot at the base of his tail, on the tips of his ears, and on his adorable little nose.

Dinner was served, a short walk enjoyed afterwards, and now the evening of relaxing together. Yes, animals have always expressed their love and trust in me, and I have always had more patience with animals than with people. His curiosity has taken him all over the small studio apartment and now all over the sofa. (three times now he has asked to be picked up - something he doesn't like because of his back pain) to come up on the sofa. I watch him and he is so smart, When he needs to go outside, he walks over to the door, barks for a moment, turns around to look at me, and says, "well, get the leash and your shoes and lets go." In only a few hours of being here, we've taken four walks and he loves them. He handles very well on a leash with light control, listens attentively to every sound around.

He may be experiencing some back pain, but I can see that this delightful, smart, and charismatic young man will have no problems finding a good home, but not until I've enjoyed working with him. I do love having him curl up in my lap while I work - my new design helper.

He so wants to be loved and to show his love, to be accepted an to feel good again. He has a home where he can have all of that and more. For now, time to transform the sofa into the bed for the evening and get ready for sleep. Will he join me, or not. Oh, the story continues.

Adonis, a 2 year old Chihuahua that has some back issues was in another foster home for a bit and he found his way to me through my decision to become a Foster Parent for Austin Pets Alive. Adonis and me, it will be good.

Car2Go and Cap Metro

There are many times that I see what should be or can be, but my visions always seem to be before their time. I see a world with Public Transportation throughout every city and that connects every city, even rural areas. Renewable energy sources power the public transportation vehicles, and they might even allow for small electric cars to easily board inter-city monorails, much like a ferry, so people could take their cars with them, but not have to drive.

My vision of improved public transportation is becoming reality, slowly, but there has to be a change in public perception about the benefits and rewards. There are many rewards, just look at some of the great public transit systems in New York, Washington DC, and even in Dallas. Less traffic, less reliance upon fossil fuels, more time to for yourself as you travel, and it's a great way to meet people or even people watch.

Not owning a vehicle anymore has presented some challenges, but thankfully here in Austin we have Car2Go and Capital Metro, not to mention many car rental companies with electric or hybrid car rentals. Car2Go's website provides car locations of their now 300 cars and you can reserve one online or through an app on your phone. The price is great when you only need a car every now and then.

Using the buses on Cap Metro, or even enjoying the light rail, allows me to keep in touch with every day people. It saves me money, a lot of money, as a monthly bus pass is only $30, and I can usually get around town easily. There are areas for improvement and expansion, and hopefully our light rail initiative will be approved by the Austin City Council.

I'm still surprised at how far behind Austin is with public transportation, but this is our Texas Capital and we should have the best public transportation in the state. Hopefully, we will have a great public transit system here that rivals those of other metropolitan areas, but for now, I enjoy riding Cap Metro and using Car2Go.

Demp the Pump Day

Thursday, June 16th is the National Day to Dump the Pump and ride Public Transortation.

I've been relying upon Public Transportation for over a month now locally, and even longer internationally. I've seen how cities that provide excellent and well thought out public system can improve the lives of those living in the city. I can go any where in D.C, Dallas, New York, and L.A. Our country needs an improved public transportation system that not only services each city, but provides routes to nearby towns and villages. Public Transportation should connect us all to our homes, friends, and work.

On Thursday at 11 AM at Brush Park, downtown Austin, Capital Metro is having a free concert. It will be a great time to relax, listen to some jaxx, and socialize with people. For more info, visit the Cap Metro SiteL

NATIONAL DUMP THE PUMP DAY

On June 16, 2011 American Public Transportation Association (APTA) and public transportation systems across the country will celebrate the 6th Annual National Dump the Pump Day.

In these tough economic times with high gas prices, everyone is looking for a way to save money. National Dump the Pump Day encourages people to ride public transportation (instead of driving) and save money.

Riding public transit is the quickest way to beat high gas prices. The latest APTA Transit Savings Report shows that a two person household that downsizes to one car can save – on the average – more than $10,000 a year.

The online toolkit below is designed to help get the word out about this year’s 6th Annual National Dump the Pump Day.

Dump the Pump

As part of the National Dump the Pump day, Cap Metro is having a contest, so I submitted my essay about 'riding on the Metro.' The prizes are good, like n iPad2 (32GB WiFi), three month's worth of Capital Metro passes, four tickets to an Austin Chronicle "Paper Cuts" concert, a commuter gift bag and a free Car2Go membership with 120 free minutes. Here's the essay I submitted.

"Riding on the Metro"

Even though I cannot hear much in crowded noisy places, when I ride the Cap Metro I hear a song by Berlin, "The Metro". No, the song isn't playing on the bus or the rail, it's in my head. There's a lot of music in my head, and I rely upon it to help me through troubling times. Recently I lost the majority of my hearing, discovered that driving gave me headaches, and thus, I quit driving. Now, I'm 'riding on the Metro' daily.

Some might say that Public Transportation is only for the low income, but I see people from every walk of life on the buses and trains. Talking with some of these people provides insight into the lives of others, and even if there isn't talk, my creative mind ponders the life stories of my fellow riders, "Who is that man in the wheel chair and where is he headed today? I see him every so often and remember seeing him at Target."

Thanks to modern technology, finding my way around is getting easier. I can text my location and destination and obtain route information. I can use the QR Code now being implemented in various locations, it is just a simple click and read to know route schedules, the information phone line is always helpful (but I rely upon the other methods because of my hearing issues), and the Cap Metro website provides schedules, routes, and information. I even use Google Maps to determine how to get around town, as it has the option to include Public Transportation as your mode of transportation.

Yes, I'm 'riding on the Metro', I've dumped the pump, and I'm discovering small businesses and interesting locations, not to mention meeting some interesting characters, throughout Austin. I'm walking more and gaining better health through the exercise. These days I'm actually enjoying the ride, as I get to see what is around me, discover areas I would not normally travel through, and learning that Public Transportation is a benefit to society. We are Austin, we should have more light rail lines, uniquely weird ones, that reflect the culture of Austin, with every rail stop being a transfer station to area buses. Can't you see it Austin? No more traffic woes, relaxing while you ride to work, special events, or even a night out on the town (think about no more DWI's). Public Transportation and Cap Metro can take us there, so sing along with me, I'm 'riding on the Metro.'

Stress Relief

Stress isn't good for anyone, especially those with compromised immune systems. Over the years I have learned many ways to deal with my stress, many of them a major frustration to friends/family, like expressing my anger and depressions. There are some situations where I cannot control the stress, only how I deal with it. The events of today didn't allow for my usual margarita afternoon, but the end result was stress relief. After meeting with ASA today, I ended up having to walk home (3 hours) in the Austin heat. My mind, that same mind with all of its creative abilities, is also the culprit of many of my issues, so while walking my mind was running full throttle and not in a good way, in the most destructive of ways.

The Universe always seems to know what I need in order to pull myself back from the brink of destruction, and today was no exception. Walking (as I call them - my walk-a-bouts) provided the energetic release, not to mention physical exercise. While walking, I stopped to obtain a drink to cool my heavily sweat soaked body, and I checked emails. A smile slowly formed as I read one particular email, as it was from a young man I had recently met and spent time with. It was a good email and brightened my day. The rest of the walk home was more enjoyable.

Upon arriving home, I checked emails again. This time to find the real stress relief I was looking for. After some issues with Social Security, the Texas Health & Human Services, and Medicare, along with knowing that project incomes wouldn't be seen until later in the month or even next month, I was very stressed over this month's income. Relief was provided through the assistance of ASA, so now I can relax, focus on writing, work on projects, and enjoy life as I have become accustomed to doing.

There are many types of stress, and we all have to find our own ways of relieving stress. So instead of enjoying margaritas, I walked, talked, screamed, and enjoyed a delightful email from a handsome young man. Talk about stress relief.

Now, I'm relaxing in my apartment working on one of the remodel concepts for a currently unremarkable home in Austin. Here's one of the concepts: The house is currently a one story ranch style with only a few notable Architectural details. This concept adds a second story, creates a new entry, and creates a usable yard.

This is what I love to do, design, model, create, and it is my most effective form of stress relief.

Military Industrial Congressional Complex

Thunder shook the walls

The thunder shook the walls, the lightning filled the mysterious darkness, sirens wailed and thoughts of what was happening and if we were secure emerged. A glance out of the front door only to confirm the thick pounding rain and watch the large Oak trees dance like doing the Salsa. A bit later and it was all calm, except for other areas near here. A tornado hit just North of Dallas and several more further Northward into Oklahoma. Golf ball sized hail hit hard and even brought a sports fans in the pro stadium scrambling for protection.

Radar weather reports showed the storm and even commented on where it was the worse, but tonight wasn't really about the storm, it was about giving. During all of the compotion Ken, my friend in Dallas, came and told me that his dog, Sleepy, was convulsing. I asked if I could see her, so we walked down the hall to where she lay on her side, every muscle in her tiny body rythmitcally pulsing and her mouth foaming. There could have been many causes, from the recent Flea & Tick drops to the wasp we found struggling to live. What ever it was, led to a few hours of providing love and comfort to this small dog. Her convulsions were so great that she had to be held to help her keep calm. In my lap with my arms tight around her, we sat. My sleeping pills kicking in and I pull out the bedding from her crate and put it on the floor. I lay her down and then, like a mother dog would do, curled myself around her so she could feel my heartbeat, my breath, and know she was OK.

A sponge to drip water slowly into her mouth seemed to help, but I wasn't sure how much she actually got. The foaming stopped, but the convulsions continued, so there we lay on the cool laundry room floor asking the animal spirits to gather to help her. About an hour later she is calming, so we sit her up on her stomach and help her drink water. Me holding her up and Ken cupping water in his hands for her. She began to respond by slapping up the water. Before the hour was over, she lay curled up on my arms peaceful. Now, after a quick shower, I'm sitting here and contemplating a thought.

When someone or something ix going through a great ordeal, do we run away, know we should help but are unable to do anything because we don't know what to do, or do we offer or own love, energy, and comfort? Tonight I gave the gift of love to a small dog, who's been struggling for some time now. I could feel her tiny heart pounding rapidly and feel each muscle contract. She's peacefully resting now, but tonight she gave me a change to share my love.

Thought for now: How many people (or even animals) do you know really need help? What do you do to help them? I believe the greatest gift we can give is our love, as pure love has no agenda, only the desire for the well being of the other.

Seven Days, One Week, Until

Seven days, one week, until another year has passed in this physical reality of time and I'll be 49. So much has happened in the last year. My thoughts wander to times past, of laughing with my grandmother, fist fighting with my mother's husband, of my wonderful animal friends I grew up with (especially my baby goat I hand raised, who was brutally shot by a mean old neighbor), of riding my horses every day, of family camp outs filled with entertainment, of places I've lived, of people long since not a part of my life but never forgotten, of dancing through the night, and so many memories of my last 48 years. My grandmother was my greatest fan, she supported me in ways that no one else understood. She was a gracious, loving, and caring woman and we shared many laughs over the years. To this day I still miss her, but I know her energy has always been with me. She used to say, “It's not the years, it's the miles.” I understand her now, as the years are relatively few, but the miles are many.

There are moments you remember all of your life, and those wonderful moments, even the sad ones, fill my mind. As I tell my friends and my doctors, “I've lived a thousand lifetimes within my years, especially considering that most people never even live, not even for a moment.” I've lived, boy have I lived. Freedom has always been the motivating factor for many of the key decisions that have shaped my life, favoring it over love, family, and even some friends. Yes, I'm free, but there are times when I ponder to reflect why and ask myself, “what have I missed?”

Living single, with only one real love, I suppose there are two (Larry and Ellen). Yes, a man and a woman, both beautiful beings who brought love and laughter into my life. If there are ever times to question the idea of gay or straight, I can see the questions in your eyes. I've always preferred relationships with men, but at the same time I have always found women most delightful company. I'm free, but at this moment, I question at what cost. There is a price to pay for everything, every decision, every action, and I've paid the price for my freedom. I see friends with husbands, wives, boyfriends, and such and curiously drift into thoughts of those I said no to so long ago, favoring my freedom over their love. What did I miss, will I make it up in the next life, will the lessons learned in this life guide me further in the next?

Pictures are always in mind, even though I do not have the actual photos now. I can see the old Chevy truck with the camper, the horse trailers, the boats, the motorcycles, and the old log cabin. I see me running happily with my new colt, which I was so proud to have. I see the wrestling and boxing matches with my older brother, even the day I kicked his butt and left him crying on the floor, all because he said, “I'm going to keep kicking your butt until you can kick mine.” Such are those moments that have shaped my life, brought me to the place of “I am.” It was those moments, those hurts, pains, loves, laughter, and triumphs that brought me here.

Is there more in this life for me? Whatever it is, I'm sure it will all be revealed, but for now, I'm content in knowing that I have lived my life for me, not based upon the ideas or limitations of religions, family, or society. Yes, there are moments you remember all your life. Even now, as I struggle to listen to one of my favorite singers, I hear what should be a sweet melody and soulful voice as shrieks and pounds upon my ears. The song is special and the message one I shall embrace.

Netflix: Make Films Accessible for the Deaf & HOH

Update: (5/3/2011) The original petition was updated/altered towards more achievable goals with Netflix, thanks to the help of Benjamin with Change.org and Chris Sanyo of Phlixie.com.

Update: (4/27/2011) Netflix does provide an option to find their current content that has Subtitles. It is located at the bottom of any of their web pages, Subtitles & Captions but there is no way to search the various Genres, instead you have to scroll through the list to find what you're looking for.

Additionally, there is now a Class Action lawsuit against Netflix in regards to this same issue. You can read more about it from the Deaf Politics website.

Having recently lost the majority of my hearing, I'm discovering the many challenges the Deaf and Hard-of-Hearing community face on a daily basis. With all of our technology, resources, and abilities, there remains a lack of equal access. Corporate good-will seems to be lacking, corporations instead wait until this issue is forced upon them through legal actions or legislation. Netflix, along with many others such as Apple, are such companies. I'm sure in time there will be petitions or public outcries towards other companies, but today I'm focused on Netflix. Below is the Petition, please show your support by signing the Petition, even if you can hear you can support access for others, so Thank You!

The Petition:

OVERVIEW
Being appreciate of the efforts of Netflix to provide Subtitles on some of their streaming content, and being thankful for such improvements to access by the Deaf and Hard-of-Hearing community, I would like to encourage Netflix to provide a detailed search option of the current subtitled content.

As it exists now, the web page that lists content with Subtitles doesn't allow a detailed search, which requires the Deaf and HOH (hard-of-hearing) limited options and time consuming searchs (or use of other resources, like Phlixie.com) for content they can enjoy.

Additionally, the Netflix web page that lists the content with Subtitles shows Television shows that have Subtitles, however, the individual Episodes are not identified as to having or not having Subtitles.

Knowing the ability of Netflix to provide searches based upon ratings and preferences, then perhaps adding a data field for the existing software can be possible to allow the subtitled content to be more readily identifiable for the Deaf and HOH.

Netflix: Make Films Accessible for the Deaf & HOH

Greetings,

Since 2009 Netflix has been working to include Subtitles (an option for Closed Captioning) for their Streaming Movies, yet, even through their extensive software and a listing of their Subtitled content on a single web page, there remains the absence of a detailed search option for such content.

Since the passage of the "Twenty-First Century Communications and Video Accessibility Act of 2010" into law on Friday, October 8, 2010, there should be captioning for programs on the Internet for the 36 million deaf and hard-of-hearing people in the United States.

Corporate responsibility and good-will, such as already shown by Netflix's willingness to provide Subtitles, should be the rule, not the exception, for providing equal access. However, such good-will should be expanded to aide the deaf and HOH in utilizing fee based services.

We hereby request that Netflix implement the following:

1. Display "With Subtitles" (or other clearly identifiable mark) below the Movie/TV Show Name on all displays of content selections as a stop-gap measure until ALL movies have CC or Subtitles.

2. Netflix to provide detailed search functionality of content with subtitles, not just a simple listing of such content.

3. Upon implementation of such, advertise heavily in the Deaf and Hard-of-Hearing Communities informing us about the implementation success.

4. Netflix to provide a "Limited Access Rate" (or a substantial discount) to any person who is Deaf or Hard-of-Hearing until ALL content provides Equal Access, which can be accomplished through a simple legal certification process of your choosing. (Perhaps through a direct email address for any deaf or HOH customers to prove such status.)

My Cathouse Design

You've see those carpet and tube forms sold in all of the pet stores for cats to climb and play upon? Well, I wanted to design something more sophisticated, so here is my CatHouse design. This one looks like a brick townhouse. The first level secretly hides the litter box, the second level houses the food and water bowls, and the other two levels are just for play. I learned a new word, Meningioma

How is one supposed to react to hearing a new word? Depending on your educational level, you might be able to determine some sort of meaning or relationship of the new word. Now, what if that new word was also accompanied with, “…it’s a non-cancerous type of brain tumor”? Whatever the word was, there doesn’t seem to be enough focus to concentrate on the actual word; the only thought being, “brain tumor.” Just how big is 12mm? After catching your breath, the other questions begin to surface.

What did you say it was called?

How do you spell it?

What does this mean?

What happens now?

I learned a new word yesterday, Meningioma. I also learned that 12mm is just under ½ of an inch; a measurement that doesn’t seem all that big. After spending most of the afternoon researching this new word, contemplating its relationship to my well-being, and recognizing my role in the how and why it is now part of my being and vocabulary, I am nervous, a bit scared, somewhat relieved, anxious. OK, so I have a small brain tumor called a Meningioma; at least I know why my hearing has decreased so rapidly, why there have been strange headaches, why I often am off-balance when walking, why there have been times of disorientation, why I struggle with memory. I’m thankful for the E.N.T. Doctor that didn’t just dismiss my hearing loss as age and ordered the MRI. I’m thankful that I know what is causing the problems. I’m thankful for friends, as for the first time in my life I didn’t keep this to myself, I talked about it. Normally I would have kept this information to myself, dealt with it all quietly, and produced some sort of excuse as to why I wasn’t available.

I’ve never believed that I should trouble friends or family with my personal health issues, and have countless times kept things away from them, only revealing the situation after the fact. Perhaps I’m growing, becoming more consciously aware of the importance of friends and being able to honestly talk about the things that strongly impact my life. This time, it was important to inform my new business partner and co-author, as I felt she needed to know what was happening and could prepare for any outcomes. This time, I wasn’t concerned about just myself. This time, there is the realization of the gift I can give of truth that allows for friends to give the gift of themselves. I’m thankful for the events of yesterday, the learning of the new word, the phone calls with my father, the conversations with friends, and the knowledge that there was actually something causing my health issues and that I wasn’t going crazy.

The journey now begins; another one that deals with my brain. I’m the creative mind, the dreamer, the visionary, the one that sees what can be; so when there are challenges that deal with my brain, I am always a bit on edge. I greatly enjoy my mind, how it processes information, how it connects to other realms, and how it allows for the enjoyment of this life. The bull-riding injury to my head (with 32 stitches from the eyebrow down over the eye and into the right ear.), the Neuro-syphilis, and now a Meningioma, have all been challenges that I’ve dealt with in various ways. This will be a new adventure, one of unknown outcomes. For now, this new adventure has my emotions whirling, my thoughts reeling, and my ears tearing. I have no idea of what to expect next, all I know for now is that I have to talk with the E.N.T. doctor on Monday and that he is going to refer me to a specialist. From my research and my positive MRI experiences, I’m hoping to be able to have this adventure include St.David’s Neuro Texas Institute here in Austin. I like the new Sports Medicine Doctor, Dr. Burris, associated with St.David’s Healthcare; I was very pleased with the kind, informative, assistive, and educated people at St.David’s when I was there for my knee and head MRIs. I’m sure that the Neuro Texas Institute will hold up to the St.David’s experience thus far.

At this moment, I’m preparing for various outcomes and believing for the best. It might take some time, but I know that this new adventure will lead me to the place and people I’m meant to be and meet. Although I might be sad at the moment, there is a funny excitement – I learned a new word, Meningioma.

Lessons I learned from Dogs.

I love animals and have always been blessed with the gift of having a strong connection with them, that person that animals are attracted to. Lately, I have often pondered why my roommate’s dogs seem to desire to spend their time with me, sleeping with me, responding easier to me, loving me. Yesterday, as I was talking with Toby, the words freely flowed from the realm of the unconscious into thought and words. I call him Old Man, but he is only 10 months old, is a rescue/foster dog hurt by a car and has difficulty using his back legs. He sleeps with me regularly now, and has the eyes of an old soul. I was a bit surprised, having to stop for a moment to listen to the words I spoke to him, as I asked why he and the other dog, Arianna, desired to hang out with me so much. These are the lessons I’m learning from dogs:

We all want to be loved, petted, and hang around those that express love and concern for us.
I should be more loyal and trusting of the people in my life.
I should express unconditional love to those around me.
We all need some discipline and structure in our lives in order to feel secure and know our place.
I should gently stroke my friends, giving praise and encouragement.
I should protect my home and my friends.
We all enjoy social interaction and having fun, being able to play.
I should seek assistance when I really need it.
I should express my emotions in ways that communicate them effectively.

These are the lessons I realized yesterday from hanging out with the dogs. I’ve always had an infinity with, a love for, and an uncanny communication ability with animals of all sorts. As I remember back, I was the one that could establish a relationship with the unruly horses; perhaps it is because I understood that one should never try to break another’s spirit in order to control them, to instead seek to develop and encourage their free spirits and allow a natural partnership to develop through trust. It has always been a bit strange that various animals have found their way to me over the years, from that little new born puppy that walked over a mile to sleep on my front door step, that little kitten that fell inside a wall next to a person’s desk that would bring them to me for care, and that one horse that everyone said was crazy but walked right up to me. I miss you Peppy Joe Rose, my horse from days past. I do so miss the horses in my life, especially Fanny Marie Lee, the buckskin horse my grandfather rescued from the rodeo circuit and who became a much loved member of our then strongly connected family.

I miss the laughter, the joy, and the love of what used to be my family; but it seems that with time our paths have all taken different directions; and time doesn’t heal all wounds. But for me, the lessons of forgiveness (not forgiveness to help them, but forgiveness to free myself), love and loyalty increase. I grow personally through the experiences of my life. Even now as I am challenged with not being able to hear well, I find ways of appreciating the silence, realizing that perhaps I haven’t always listened as I should and that now it requires my full attention to speak with friends. There are lessons in everything and through every person in our lives, the difference is whether we choose to acknowledge those lessons, learn from them, and grow.
